Chapter 52

א ולא מורידין אבל המינין והמסורות והמומרים היו מורידין ולא מעלין
1 though they should not be cast in, but heretics, informers, and apostates may be cast in, and need not be brought up.
ב א"ל אני שונה (דברים כב, ג) לכל אבידת אחיך לרבות את המומר ואת אמרת היו מורידין סמי מכאן מומר
2 R. Yohanan said to him: I have been teaching “And so shall you do with every lost thing of your brother's” (Deuteronomy 22:3) that this comes to include the apostate, and you say he may be cast down. Erase [from this list] apostates!
ג ולישני ליה כאן במומר אוכל נבילות לתיאבון כאן במומר אוכל נבילות להכעיס קסבר אוכל נבילות להכעיס מין הוא
3 But let him resolve that the one might apply to the kind of apostate who eats carrion to satisfy his appetite, and the other to an apostate who eats carrion to provoke? In his opinion, an apostate eating carrion meat to provoke is the same as a heretic.
ד איתמר מומר פליגי רב אחא ורבינא חד אמר לתיאבון מומר להכעיס מין הוי וחד אמר אפילו להכעיס נמי מומר אלא איזהו מין זה העובד אלילי כוכבים
4 It was stated: [In regard to the term] “apostate” there is a disagreement between R. Aha and Ravina; one says that [he who eats forbidden food] to satisfy his appetite, is an apostate, but [he who does so] to provoke is a heretic; while the other says that even [one who does so] to provoke is merely an apostate. And who is a “heretic”? One who actually worships idols.
ה מיתיבי אכל פרעוש אחד או יתוש אחד הרי זה מומר והא הכא דלהכעיס הוא וקתני מומר התם בעי למיטעם טעמא דאיסורא
5 They objected: If one eats a flea or a gnat he is an apostate. Now here this must have been done to provoke, and yet we are taught that he is merely an apostate! Even in there he may just be trying to see what a forbidden thing tastes like.
ו אמר מר היו מורידין אבל לא מעלין השתא אחותי מחתינן אסוקי מיבעי אמר רב יוסף בר חמא אמר רב ששת לא נצרכא שאם היתה מעלה בבור מגררה דנקיט ליה עילא ואמר לא תיחות חיותא עלויה
6 The Master said: They may be cast in and need not be brought up — if they may be cast in, does it need to say they need not be brought up? R. Joseph b. Hama said in the name of R. Sheshet: It is only necessary to teach that if there was a step in the sides of the pit, one may scrape it off, giving as a reason for doing so that a wild animal should not go down in there.
ז רבה ורב יוסף דאמרי תרוייהו לא נצרכא שאם היתה אבן על פי הבאר מכסה אמר לעבורי חיותא עילויה רבינא אמר שאם היה סולם מסלקו אמר בעינא לאחותי ברי מאיגרא
7 Raba and R. Joseph both of them said: It was only necessary that if there is a stone lying by the pit opening, one may cover the pit with it, saying that he does it for [the safety] of passing animals. Rabina said: It is was only necessary that if there is a ladder there, he may remove it, saying, I want it for getting my son down from the roof.
ח ת"ר ישראל מל את העובד כוכבים לשום גר לאפוקי לשום מורנא דלא ועובד כוכבים לא ימול ישראל מפני שחשודין על שפיכות דמים דברי רבי מאיר
8 Our Rabbis taught: An Israelite may circumcise a non-Jew for the purpose of becoming a proselyte, but not for [the purpose of] removing a worm. But a non-Jew may not circumcise an Israelite, because they are suspected of murder, the words of R. Meir.
ט וחכמים אומרים עובד כוכבים מל את ישראל בזמן שאחרים עומדין על גבו אבל בינו לבינו לא ורבי מאיר אומר אפילו אחרים עומדים על גבו נמי לא דזימנין דמצלי ליה סכינא ומשוי ליה כרות שפכה
9 The Sages said: A non-Jew may circumcise an Israelite, so long as others are standing by him, but not while he is on his own. R. Meir said: Not even when others are standing by him, for he may find occasion to let the knife slip and so cut off his genitals.
י וסבר ר"מ עובד כוכבים לא ורמינהו עיר שאין בה רופא ישראל ויש בה רופא כותי ורופא עובד כוכבים ימול עובד כוכבים ואל ימול כותי דברי ר"מ רבי יהודה אומר ימול כותי ואל ימול עובד כוכבים
10 Does then R. Meir hold that a non-Jew is not [to be allowed to circumcise]? But the opposite is proved by the following: In a town where there is no Jewish physician, but there is a physician who is a Samaritan and one who is a non-Jew, let the non-Jew circumcise and not the Samaritan, the words of R. Meir. R. Judah said: Let the Samaritan circumcise and not the non-Jew.
יא איפוך ר"מ אומר ימול כותי ולא עובד כוכבים ר' יהודה אומר עובד כוכבים ולא כותי
11 Reverse [the names]: R. Meir says that the Samaritan and not the non-Jew can circumcise, and R. Judah says the non-Jew and not the Samaritan.
יב וסבר ר' יהודה עובד כוכבים שפיר דמי והתניא ר' יהודה אומר מנין למילה בעובד כוכבים שהיא פסולה שנא' (בראשית יז, ט) ואתה את בריתי תשמור
12 Does then R. Judah hold that a non-Jew may circumcise? But has it not been taught: R. Judah said: From where can it be deduced that circumcision performed by a non-Jew is invalid? From this verse, “And as for you, you shall keep my covenant” (Genesis 17:9).
יג אלא לעולם לא תיפוך והכא במאי עסקינן
13 Indeed, do not reverse the positions, but say that we are here dealing
